3. Products and Descriptions

WHY NOT offers ski goggles and related products.

We make reasonable efforts to ensure that product descriptions, photographs, colours, specifications and prices are accurate. However, colours may appear differently depending on your screen and display settings.

Product performance claims, including UV protection, anti-fog performance, lens compatibility and durability, apply only to the extent supported by the relevant product specifications and testing.

Product images are illustrative where expressly stated. Material characteristics, safety information and relevant limitations will be disclosed in the product listing where required.

Nothing in this section limits your statutory rights if a product is defective, unsafe or does not conform to its description.

4. Prices and Payments

All prices, applicable taxes, shipping charges and other mandatory costs will be displayed or disclosed before you complete your order.

We currently intend to accept eligible card payments through Shopify Payments or the payment options displayed at checkout.

Payment processing may be subject to the applicable payment provider's terms and policies.

If a genuine pricing or technical error occurs, we will contact you and handle the situation in accordance with applicable law. We will not use this provision to cancel orders arbitrarily or avoid contractual obligations.

5. Orders and Contract Formation

When you submit an order, you offer to purchase the selected products under the terms presented at checkout.

You will receive an order confirmation acknowledging receipt of your order. Whether that confirmation also constitutes acceptance of the order will depend on the checkout process and applicable law, as explained during the purchase process.

We may decline or cancel an order where there is an objectively justified reason, including suspected fraud, a genuine stock error, an inability to fulfil the order or a legal restriction.

If payment has already been collected for an order that is cancelled, we will arrange any refund due in accordance with applicable law.

Available delivery destinations, shipping fees and estimated delivery times will be displayed at checkout or in our Shipping Policy.

Delivery estimates are estimates unless a specific delivery date has been expressly agreed. We will comply with applicable statutory delivery deadlines.

You are responsible for providing an accurate delivery address. If you discover an error, contact us as soon as possible. We cannot guarantee address changes after dispatch.

Any voluntary commercial warranty offered by WHY NOT is additional to statutory rights and does not replace or reduce them.

Customers must follow the product instructions, warnings and safety information supplied with the product.

Do not use goggles that are damaged or have impaired visibility. Do not use products beyond their stated purpose or capabilities.

Ski goggles do not eliminate the risk of injury and are not a substitute for a suitable ski helmet or other required protective equipment.

Nothing in these Terms excludes liability for defective products, personal injury or any other liability that cannot lawfully be excluded.

10. Intellectual Property

The WHY NOT name, logos, original product imagery, text, graphics and Website content are owned by or licensed to WHY NOT, unless otherwise stated.

You may not reproduce, distribute, modify or commercially exploit protected content without prior written permission, except where permitted by applicable law.

Purchasing a product does not transfer ownership of our trademarks or other intellectual property.

We take reasonable steps to maintain Website availability and security, but uninterrupted access cannot be guaranteed.
